ROGUE DSP Waitlist Terms
Effective on publication. The current legal page records when this version took effect.
The free ROGUE DSP waitlist is run by Fluxcode Studio LLC, an Ohio company at 5240 Parkmoor Drive, Westerville, OH 43082, USA. Joining requests confirmation and welcome emails, a personal beta invitation if we admit you, and one email when the ROGUE DSP store opens to the public. It creates no account, purchase or right to enter the private site. This release offers no marketing signup.
Your place
You must be at least 18, and old enough to agree to these Terms where you live. Join for yourself with an email address you control or are authorised to use. By checking the age and Terms box and pressing “Join the list,” you accept these Terms and request the stated waitlist messages.
Confirm within 72 hours of your latest request using the button or link in your confirmation email. Pressing the button from the network you signed up on can confirm you straight away; otherwise the page that opens asks you to press Confirm. If you did not request the email, ignore it or use its cancel link. If you have not confirmed, we may send one reminder within 7 days of your request, then nothing more unless you ask again. Because we cannot tell who typed an address, that reminder can also reach someone who did not ask. Ignoring it still leaves the address off the list, and the cancel link stops it. There is one place per inbox; simple address variations do not create extra places. Repeat requests are limited and may resend your confirmation or welcome message.
Apart from that one store-opening email, which says the store is open, links to it and carries no offer, joining the waitlist never grants marketing permission. If we later offer ROGUE DSP product news, new plugins or occasional offers, we will first show a separate, unticked affirmative choice and any notice required for that message. Mail from any other Fluxcode business remains separate.
A place is not a promise of admission, a launch date, product, price or availability where you live. Keep confirmation, private place and leave links private. Only your referral link is for sharing.
Optional referrals
Everyone who joins through your link and confirms their address moves you three places up the list. We generally invite people to the private beta from the top of the list, and we may also invite anyone directly. We show a range, such as “Top 500,” and your referral count; a referral may not change the range you see until it moves you into the next one. Your place is based on when you confirmed, less your credit, and cannot move ahead of first place. It improves when people who confirmed before you leave. People who join after you, and other people's credit, do not move you back, so more than one person can share a calculated place. Before you confirm, the range shown is only where you would join at that moment. Credit has no cash value and does not promise an invitation.
Credit counts while both signups are confirmed and eligible, unless held for review. Earned credit does not expire automatically after 24 months while both linked signups are retained. If either person leaves, it stops counting. Deleting either signup removes that referral record.
When sharing, explain that you may move up the list if someone joins. Share on your own channels where allowed, or with someone who asks. Do not send unsolicited or bulk messages, scrape or buy contacts, use paid ads or referral-swap sites, create fake signups, or buy, sell, swap or reward referrals. We provide a copyable link and do not contact friends for you. Referring anyone is optional.
Leaving and fair use
Use the link and page button in a waitlist email to leave. You can also reply to that email or write to [email protected] or [email protected]. We do not treat a visible sender address or message header as proof of identity, so before an emailed request changes the list we check it with the confirmed signup address. A plain-text message saying only STOP, UNSUBSCRIBE or REMOVE ME normally gets a one-use link at that address automatically and pauses mail to it for up to 7 days. Any other message, including most replies from ordinary email apps, goes to a person, who answers within applicable legal deadlines. It does not pause mail by itself. No account, password or payment is needed. Leaving ends your place and waitlist mail. You can ask us to stop future marketing if it is ever offered, or request deletion as explained in our Privacy Notice. Rejoining the waitlist is not currently available. If we offer it later, fresh confirmation will be required; restoration of an earlier place or referral credit is not promised.
Do not misuse someone else's address, automate fake entries, bypass safeguards, interfere with the service or harass people. We may hold unusual referrals for review or remove entries that materially break these rules. A hold is not a finding of wrongdoing. Unless an entry is clearly fake or notice would undermine an investigation, we explain a removal by email. Ask [email protected] for human review. If we made a mistake, we explain the correction available for your entry. Privacy requests remain available.
Our name, branding, content and software belong to us or our licensors. You may share your referral link and discuss ROGUE DSP, but may not imply that you represent us.
Changes and responsibility
We use reasonable care, but cannot promise uninterrupted availability. We may pause the list for maintenance or misuse, or close it. We ordinarily give 30 days' closure notice and explain what happens to records; legal requirements, misuse or events outside our reasonable control may require earlier closure. The store-opening email can serve as that closure notice.
A material change is one that reduces your rights, adds something you must do, or worsens how your place or referral credit works. Adding an optional benefit takes nothing away and is not a material change; we state its conditions when we offer it. Material changes receive at least 30 days' advance notice on the waitlist page and email to affected confirmed members eligible to receive it. Required notice must be completed before a change takes effect. Changes apply at midnight US Eastern Time on the stated date, never retroactively. We tell eligible recipients if an announced change is cancelled. Legal requirements or fraud may require earlier action with notice as soon as possible; harmless corrections can apply on posting. New permission is obtained where required. Staying never grants new marketing permission.
Forming another Fluxcode company does not automatically transfer this list or your choices. A future operator must legally take on these commitments and preserve your choices. We give at least 30 days' notice of its identity, contacts and handover date, with any required choice. You may leave or request deletion first. Common ownership does not give another Fluxcode business permission to use this list.
To the extent law allows, our total liability for this free waitlist is limited to US$100, and we exclude indirect or consequential loss and lost profit, business or opportunity. These limits do not cover fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, or anything law prohibits us from limiting. Your mandatory consumer and privacy rights remain.
Ohio law and Ohio state or federal courts apply, subject to your mandatory local protections and court rights, including available small claims routes. There is no compulsory arbitration, class-action waiver or shortened claims period. An unenforceable provision does not invalidate the rest. Your place cannot be transferred.
